Pursuant to the Sustainable Growth & Agricultural Preservation Act of 2012 (the septics law), every local jurisdiction with planning and zoning authority is directed to submit a map showing the implementation of their adopted growth tiers. Below are links to the map and document for each county and municipality that has transmitted this information to MDP. There is also a link to a copy of MDP’s response to those jurisdictions that have submitted this information. The Act allowed jurisdictions to change their definition of a minor subdivision, as it applies to the provisions of the law, up until December 31, 2012. The link titled “View Minor Subdivision Definition Changes” opens a table describing the definition of minor subdivisions in the 23 counties and Baltimore City.

Description of Columns
- Local Documentation and Adopted Tier Map: In this column, you will find links to the jurisdiction’s adopted tier map and its local ordinance, resolution or adoption letter indicating that the growth tier map has been adopted in accordance with the septics law. In the case of municipalities, some have elected not to develop a map and instead have submitted documentation indicating they have adopted their county’s version of the map. Municipalities without planning and zoning authority are mapped by the county as well; these municipalities will have a value that reads “Mapped by County” in this column. Several counties submitted additional documentation explaining the methodology employed during their tier mapping designation process. In these instances, the “Info” will provide this additional documentation.
- MDP Response: This is the formal reply letter from the Maryland Department of Planning (MDP) to the local jurisdiction following the receipt and review of the adopted growth tier map. Following an evaluation of the map for consistency with the criteria set forth in the septics law, MDP sends this response letter to jurisdictions who have adopted maps. The letter informs the jurisdiction whether they have met the criteria of the law and if they will be required to hold a public hearing to address formal comments by MDP.
